Al-Ghazālī’s Theory of ‘Illah and Maqāṣid al Shari‘ah: An Assessment of Mr. Nyazee’s View on Al Shaf‘ī

Abstract

Al Shafi is widely recognized as the pioneering figure of the discipline of usool al fiqh. Mr Imran Ahsan Nyazee categorized Al Shāfī’s views on qiyas with the likes of Dawood al Zāhirī – the staunch critic of qiyas. Nyazee employed al Ghazālī’s theory of qiyas and illah (cause) to come up with the ideas that al Shafi’s theory was very restrictive in nature and that he did not approve of qiyas al ‘illah. In this article, we have explained al Ghazālī’s theory of ‘illah and maqāṣid al shariah in detail so as to determine the validity of Nyazee’s claims that al Shāfī had no concept of qiyās al ‘illah and that his book al Risālah offers no example of it. The article also elaborate how al Ghazālī provided theoretical underpinnings and foundaitons to the concept of maqāṣid al shariah that are rarely discussed by scholars.
